Terms of Service


1. Acceptance of Terms


By accepting this Terms of Service electronically or in writing and by using Hope Floats Website Design's services, the client agrees to be bound by these terms and conditions. The client therefore agrees that electronic acceptance of this Terms of Service shall have the same force and effect as if he/she agreed to this Terms of Service in writing.

Hope Floats Website Design provides its services to the client subject to this Terms of Service, which may be updated from time to time without prior notice. The client should periodically review the most current version of the Terms of Service at

By using Hope Floats Website Design's services the client agrees to (and hereby signs) the most current version of the Terms of Service. If the client does not expressly reject the Terms of Service and cancels the instructions given to Hope Floats Website Design, the client agrees to (and hereby signs) the Terms of Service and Hope Floats Website Design will commence work on the client's website as if the client had expressly accepted the Terms of Service.

The client's acceptance of the Terms of Service is binding upon all Hope Floats Website Design services, including additional work on the client's website at a later date.

2. General


Any instructions given to Hope Floats Website Design to register a domain, set up hosting, design a website or make changes to an existing website is deemed to be a written or verbal contract between Hope Floats Website Design and the client; this includes telephone and email agreements.

3. Description of Service


Hope Floats Website Design designs and develops websites and provides other website-related services including domain registration, hosting, setting up of email addresses and SEO.

4. Domain Name Registration & Hosting


A domain registration and hosting order requires an electronically submitted or handwritten order form as well as full payment for 1 year. Domain and hosting is renewable annually.

5. Website Design Procedure


The commencement of a website design project requires an electronically submitted or handwritten order form, payment of a 50% deposit, the client's logo and any other element that is required to be used in the design. The client may submit the logo and other content to Hope Floats Website Design electronically.

Hope Floats Website Design will then design the website and provide the client with a temporary website address where the progress of the website can be followed. The website will be uploaded to the client's domain only after the client's design approval has been received.

Making of changes to an existing website requires instructions from the client either electronically or verbally. The client will be able to view the changes made to the website on the client's domain and should give feedback/approval to Hope Floats Website Design.

6. Completion Time


The client understands, agrees and acknowledges that Hope Floats Website Design does not guarantee a time for completion of any website. This is in part because it is difficult to complete a website without design approvals and participation from the client. In addition, if the client continues to submit additional content throughout the design process or requests additional modifications to the website's design, the completion time is increased.

If the client does not respond to Hope Floats Website Design communications and, as a result, Hope Floats Website Design is not able to start or complete the website, the client is still responsible for all fees incurred during the website design phase.

The client understands and agrees that if the client does not respond to requests for missing information, a final notification will be sent to the client. If the client does not respond within 10 business days to Hope Floats Website Design's notification or request for missing information, the website along with the functionality of the website and the services rendered, will be deemed to be approved by the client, and the website will be uploaded to the client's domain with the missing information "as is" or "under construction".

7. Client Approval


Once a temporary website address has been given to the client (by email), the client should test the website and give feedback/approval to Hope Floats Website Design. The client understands and agrees that if the client does not within 10 business days respond to Hope Floats Website Design's request for feedback/approval and notification that the website has been uploaded to a temporary domain, the website will be deemed to be approved by the client and the client agrees services have been rendered and the functionality of the website has been tested and approved by the client.

In the event that Hope Floats Website Design completes all of the work per the original instructions, Hope Floats Website Design reserves the right to move the website to the client's domain and deem the work to be completed without the client's permission if the client will not give approval of the work.

8. Scope of Work


The client understands that the website design includes a specific number of pages, features and/or functionality. Additional work requested by the client outside of the scope of work initially may be charged at an hourly rate.

Hope Floats Website Design agrees to design a website per the original instructions and order form. Any additions or changes requested outside of the scope of the original instructions, either prior to the website being uploaded to the client's domain or after the website has been uploaded to the client's domain, will be billed at Hope Floats Website Design's standard hourly rate. The client is obligated to pay all fees incurred and due.

Hope Floats Website Design reserves the right to remove the entire website from the Internet and cancel a client's hosting and domain if payment is not received for work that has been completed.
